Will contest

  • The validity of a Will may be contested through a procedure authorized by R.C. 2107.71, et seq.

Any person "interested" in a Will or codicil may contest its validity. An interested person has been defined as one who, at the time of the commencement of an action to contest a Will, has a direct pecuniary interest in the estate of the putative testator that would be impaired or defeated if the Will is found to be valid.

A Will contest action must be brought within 3 months of the filing by an executor of the certificate required by R.C.2107.19 (stating that the appropriate persons have received notice that a Will was admitted to probate)
